- Chapter 1.General Provisions, Contacting the Shop Owner
- These terms and conditions (hereinafter referred to as "Terms and Conditions") govern the terms of use of the online shop WND CarParts, operated at https://wndcarparts.eu/.
- The owner of the Shop is Wojciech Piotrowski, trading under the name WOJCIECH PIOTROWSKI BTM PARTS with registered office at: ul. Zdrowa 14, 55-020 Wojkowice, Tax ID (NIP): 8-961-417-604, and Damian Daniel Sonik, trading under the name DAMSON DAMIAN SONIK with registered office at: ul. Wrocławska 2c, 55-010 Żerniki Wrocławskie, VAT ID: 8-961-500-423, jointly operating as a civil law partnership under the name WND GROUP WOJCIECH PIOTROWSKI DAMIAN SONIK S.C. with registered office at: Zasłuczańska 4, 55-010 Żerniki Wrocławskie, VAT ID: 8-961-655-048, REGON: 542-289-908 (hereinafter referred to as the "Seller").

- Chapter 2.Technical Requirements
- To use the Shop, you need:
- a computer or another device with a web browser;
- internet access;
- an active email address.

- Chapter 3.Personal Data
- The Seller is responsible for the processing of the personal data of the Shop's customers.
- All information regarding the processing of personal data of customers and other users of the Shop website can be found in the Privacy Policy.
- Chapter 4.Conclusion of the Sales Contract, Customer Account
- The Shop allows you to purchase goods (hereinafter referred to as "Goods") displayed on the Shop's website in two ways: Without registration; or By creating a customer account in the Shop. In both cases, you select the desired Goods in the Shop, add them to the cart using the corresponding button, and complete the order process by choosing the desired options (delivery and payment method). The product information in the Shop, i.e., descriptions and prices, constitutes an invitation to conclude a sales contract within the meaning of Article 71 of the Civil Code in accordance with the Terms and Conditions. The requirement for an order is the full provision of all data necessary for the performance of the contract and, if requested, data for the creation of a VAT invoice. If the customer creates an account in the Shop (hereinafter referred to as the "Account"), registration occurs once. The email address and password chosen by the customer serve for subsequent logins. Details on account management by the Seller can be found below in the Account Terms. The Shop also allows login via social media and/or a Google user account. After logging into the account, the customer has access to their order history and does not need to fill in the order form with their personal data again for subsequent orders. The customer can cancel their account at any time free of charge. To do so, please send your cancellation to the following email address: wndcarparts@gmail.com.
- Confirmation of the order by the customer via the "Buy and pay" button (or another button with the same label) means:
- the submission of an offer to the Seller to purchase the Goods according to the options selected in the order and according to these Terms and Conditions,
- the acceptance of the obligation to pay the price of the Goods and the delivery costs.
- The sales contract (hereinafter referred to as the "Contract") is concluded upon acceptance of the order by the Seller (acceptance of the customer's offer). The Seller informs the customer of this by email and confirms acceptance of the order.
- If the order for the Goods (in whole or in part) cannot be fulfilled, the Seller informs the customer; in this case, no contract is concluded. The Seller also informs the customer about alternative ways to fulfill the order, e.g., partial delivery or waiting time until stock is replenished. If the order has already been paid for by the customer and cannot be executed, the Seller will immediately refund the payments made by the customer (depending on the scope of the cancellation). The Seller will issue a confirmation of the conclusion of the contract to the customer on a durable medium at the latest upon delivery of the Goods. The Shop is not liable for non-delivery or delay in delivery of the order if these are due to the customer providing an incomplete/incorrect delivery address or failing to provide other information necessary for the execution of the order. The Seller reserves the right to suspend the execution of the order if the customer has provided false information or if such information raises reasonable doubts about its accuracy. In such a case, the Seller will attempt (if possible) to contact the customer to verify the accuracy of the data provided.
- Chapter 5.Prices and Payment Methods
- The prices of the Goods are stated in Polish Złoty (PLN) and as gross amounts, i.e., including VAT.
- Shipping costs are displayed separately in the Shop's shopping cart, depending on the shipping method chosen by the customer.
- If the customer chooses payment by standard bank transfer, payment is due within 3 days after the order. If payment is not received within this period, the contract is deemed void. The previous sentence does not apply to cases where the Seller offers the customer deferred payment/installments through an external partner.
- Chapter 6.Delivery of Goods
- The delivery of goods takes place according to the customer's choice:

With the exception of Goods that the customer picks up personally, the order is deemed completed upon shipment of the Goods to the customer (handover of the shipment to the carrier). The exact delivery date is determined by the carrier. The Goods will be shipped by the Seller within 2 business days, unless a different delivery time is specified in the product description when ordering. Detailed delivery times can be found on the Shop's website under the "Processing Time" tab. The Seller generally processes orders within the Republic of Poland. The costs for this are specified on the Shop's website under the "Delivery Time and Costs" tab. International shipping is possible. The costs for this are based on the information on the Shop's website or are agreed individually with the customer.
- Chapter 7.Withdrawal from the Contract
- A customer who is a consumer or an entrepreneur within the meaning of Art. 7aa of the Consumer Rights Act (hereinafter referred to as a "privileged entrepreneur") has the legal right to withdraw from the sales contract within 14 days of receipt of the goods without giving reasons, subject to the exceptions mentioned below. To meet the withdrawal deadline, it is sufficient for the customer to send a declaration within the specified period: in electronic form to the following address: wndcarparts@gmail.com or in writing to the following address: ul. Zdrowa 14, 55-020 Wojkowice.
The declaration of withdrawal can be submitted using the template – Download Template. Use of the template is not mandatory. The Seller will immediately send the customer an email confirming receipt of the withdrawal declaration. Subsequently, the customer must return the Goods at their own expense within the next 14 days to the following postal address: ul. Zdrowa 14, 55-020 Wojkowice.
- The Seller will refund the following to the customer immediately, but at the latest within 14 days of receipt of the withdrawal declaration:
- the price of the Goods;
- the costs of the original shipment of the Goods to the customer using the cheapest standard shipping method offered by the Shop.
- The Seller may refuse the refund until the Goods have been received back or the customer has provided the Seller with at least proof of return of the Goods.
- The refund will be made using the same means of payment that the customer used for the original transaction, unless the customer has expressly agreed otherwise.
- The customer is liable for any reduction in the value of the returned Goods if they used them prior to submitting the withdrawal declaration in a manner that was not necessary to inspect their condition, characteristics, and functionality.
- Chapter 8.Exceptions to the Right of Withdrawal from the Sales Contract
- The right of withdrawal does not apply to contracts for the delivery of Goods:
- non-prefabricated goods made to customer specification or tailored to individual needs (personalized goods);
- goods that deteriorate quickly or have a short shelf life (perishable goods);
- goods delivered in a sealed package if this has been opened by the customer and the goods cannot be returned for reasons of health protection or hygiene after opening (hygienically sealed goods);
- audio or video recordings or computer software delivered on a data carrier (e.g., a CD) in a sealed package if this was opened after delivery;
- which, due to their nature, are inseparably mixed with other goods after delivery (e.g., building materials, if used);
- The right of withdrawal does not apply to contracts for the delivery of Goods:
- Chapter 9.Complaints
- The Seller is obliged to deliver the Goods to the customer in accordance with the agreement.
- The Seller is liable to consumers and privileged entrepreneurs for the compliance of the Goods with the provisions of the Consumer Rights Act. The Seller is liable to other customers in accordance with the provisions of the Civil Code.
- Complaints can be submitted:

- The Seller will process the complaint in the form in which it was submitted (in writing or by email) within 14 days of receipt of the complaint.
- If you are not satisfied with the Seller's handling of your complaint, you, as a consumer and as a privileged entrepreneur (independently of ordinary proceedings before a regular court), may also use out-of-court means for settling complaints and asserting claims.
- To this end, you may:
- contact the competent provincial inspector of the Trade Inspection and submit a request to initiate mediation proceedings for an amicable settlement of the dispute;
- contact a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection;
- contact a permanent consumer arbitration court to settle the dispute arising from the concluded contract.

- Chapter 10.Product Reviews
- Customers can add product reviews (hereinafter referred to as "Reviews") in the Shop.
- This function is only available if the customer uses an external program for customer satisfaction/opinion surveys.
- If a review is blocked or deleted, the Seller will inform the customer and state the reasons. In this case, the customer may lodge an appeal in accordance with the provisions in Chapter 10, point 6 of the Terms and Conditions.
- Appeals against decisions regarding reviews (hereinafter referred to as "Appeals") can be submitted:

- Chapter 11.Final Provisions
- Polish law applies to contracts concluded in the Shop. The contract was concluded in the Polish language.
- No provision of these Terms and Conditions excludes or limits in any way the rights of the consumer (and the privileged entrepreneur) in accordance with the legal provisions.
- The Seller may change the Terms and Conditions at any time. The changes apply to orders placed after publication of the new version of the Terms and Conditions. In the case of (i) previously concluded contracts for the provision of a digital or electronic service, as well as in the case of (ii) customers with an account in the Shop, the customer will be informed of the change to the Terms and Conditions and have the opportunity to reject the new content.
- The Terms and Conditions apply from November 22, 2025.

- Chapter 1.General Provisions, Contact with the Seller
- These Account Terms ("Account Terms") govern the use of the customer account ("Account") in the WND CarParts online shop ("Shop").
- These Account Terms for the customer account constitute the conditions for an electronic service within the meaning of the Act on the Provision of Electronic Services. The customer account service is a complementary service to the Seller's main business, i.e., offering the purchase of goods to customers. Use of the customer account service is free of charge. The Account Terms supplement the General Terms and Conditions of the Shop. Unless otherwise regulated in the Account Terms, the provisions of the Shop's General Terms and Conditions apply to this service.
